ICE Detainer Placed on Man Charged With Raping 3-Year-Old

( --  Luis Enrique Marin Noyola, a 20-year-old Hispanic man, was arrested by Winston-Salem police officers and charged with raping a 3-year-old, and a U.S. Immigration and Customs Enforcement (ICE) detainer has been put in place in the case.

According to the Winston-Salem Police Department, Noyola entered an apartment on Bruce Street in Winston-Salem, N.C., early on Sunday morning, Mar. 9, and raped the 3-year-old and then fled the scene. After further investigation, police arrested Noyola on Mar. 11.

Noyola was charged with First Degree Burglary, First Degree Rape, First Degree Sex Offense and Indecent Liberties with a Child. His bail is set at $800,000.  Because the investigation is ongoing, Noyola’s photograph is not being released at this time, said the police in a statement.

The police had initially said the victim was 5 years old and then corrected their report to note the victim actually is 3 years old. The police statement said that Noyola “is a friend of an acquaintance of the victim’s family.”

An ICE detainer for Noyola is in place, the Winston-Salem police told  According to ICE, a detainer, or Form I-247, is a notice that the Department of Homeland Security issues to law enforcement agencies stating that ICE intends to assume custody of an individual that is in that agency’s custody.

“Detainers are critical for ICE to be able to identify and ultimately remove [from the United States] criminal aliens who are currently in federal, state or local custody,” says ICE on its website.
