More than three thousand pediatricians and health care professionals are suing the Biden Administration for requiring gender-related care and surgeries, regardless of doctors' medical or ethical objections.
Christian conservative nonprofit the Alliance Defending Freedom (ADF) is representing the American College of Pediatricians, an OB-GYN doctor, and the Catholic Medical Association in this suit, announced ADF’s press release.
On his first day in office, President Biden issued an executive order that changed the definition of gender to include sexual orientation and gender identity in the Affordable Care Act. As a result, medical professionals are currently required to provide gender reassignment care and surgery to all people, including children, according to the press release.
“This mandate not only puts the health and safety of our patients in jeopardy, but it in effect also mandates that healthcare providers give up their fundamental right to conscience,” Catholic Medical Association President Dr. Michael Parker said in his group's press release. “This sets a dangerous precedent with incalculable implications for the ethical practice of medicine.”
ADF filed the lawsuit, American College of Pediatricians v. Becerra, Thursday with the U.S. District Court for the Eastern District of Tennessee at Chattanooga, according to The Daily Wire.
However, these plaintiffs are not the first healthcare professionals to object to Biden’s mandate.
In attempts to prevent doctors from being forced to perform gender transition procedures and care, “The case of Franciscan Alliance v. Becerra was brought by a religious hospital, an association of over 20,000 healthcare professionals, and nine states,” according to a Becket Law Group press release.
On Aug. 9, 2021. Judge Reed O’Connor of the District Court for the Northern District of Texas in Wichita Falls ruled in favor of the healthcare professionals, reported Catholic Sentinel. The court agreed with the plaintiff's contention that this mandate violated healthcare professionals’ rights under the Religious Freedom Restoration Act.
In reference to how this ruling could impact the outcome of American College of Pediatricians v. Becerra, Luke Goodrich, vice president and senior counsel for Becket Law Group, stated that he believes the evidence will continue to favor healthcare providers.
“There is ample evidence that gender-transition procedures can be deeply harmful to patients, especially children,” Goodrich told CNSNews.com. “No doctor should be forced to perform these controversial procedures in violation of her conscience or experienced medical judgment. Both courts to consider the Biden Administration’s transgender mandate have struck it down as unlawful, and we expect this court to do the same.”
