When House Speaker Nancy Pelosi (D.-Calif.) was asked where Constitution gives Congress authority to mandate that every American buy health insurance, she responded: "Are you serious?"

To 'jsamans' to answer his question as to why this reform is Unconstitutional and the Commerse Won't cover it. 1) The will of the People or the will of one People to have the insight and perservernace to care enough to get it through. 2) The difference here is the Individual Citizen is being made(REQUIRED) to participate; required to purchase...a health insurance plan( no it is not like a drivers license where the state requires insurance(that is a CHOICE to the individual IF they wish to drive a car; they don't have to as it is a PRIVILEDGE). The Constitution provides for the freedom of EACH and EVERY US citizen to be free of oppression from the Congress! The Congresss can NOT require an individual to buy insurance; further the Congress can't REQUIRE a citizen to purchase another person's insurance. Anyway; this is not about health; it is about Hussein Obama's Communist and Marxist government take over every person and every person's whereabouts and every persons money, cars, etc.

Pelosi you are so stupid. You don't even know what is in the Constitution. And you took an oath to uphold it. And Pelosi, you have not READ the 2,000 pages of this bill. And if you did read it you would not even understand it for you are a stupid women. You are stupid because you are comitting treason agasint the United States of America and that is the worst thing one can do. You are suppose to be protecting the constitution; instead you are destroying it. What a poor excuse for a person you are. I hope someday you get this type of awful health care where you need immediate attention but, it does not come; that is this reform. It makes things horrible. The People wanted regulation on the big insurance; intead you has destroyed the people's liberty and freedom. Where in the world did you come from?

@jsamans, Your comment doesn't address the question. Congress may only do those things specifically allowed by the Constitution. This isn't an argument about which unconstitutional things other people might like. That's a red herring. Also, you are relying on the two wrongs make a right fallacy. The last time I checked the United States of America is still a government of laws and not of men. (In case you're an illiterate liberal, "men" means humans).

If you can take a moment to stop spouting your sound bites from the latest Glenn Beck airing, might you explain why you think it would be unconstitutional for the U.S. government to mandate health insurance? Before you respond, you might be interested to know that the basis for the Partial Birth Abortion Ban Act was the Commerce Clause of the Constitution. Count to thirty as you think that through, then explain to me why you imagine that mandating health insurance is beyond the powers of the Constitution.

IMO, this should be our #1 priority – to fight back and defeat any national health care bills. Hopefully the GOP will get its act together (getting back to conservative principles) and we can win back the White House and Congress by 2012. In that case, we can easily cut taxes, roll back much of the trillions of BHO’s profligate spending, sell GM and banks back to the private sector, and reverse a lot of the damage caused by BHO. But if ‘National Hell Care’ passes – once in effect it will be very hard to reverse. Just look at England. Tea parties are great – i.e., using tea bag boxes and “Taxed Enough Already” signs as symbols. What we really need now are anti-NHC rallies, such as we saw in the 1990s against ‘Hillary-Care’. As I remember a scene from Rush Limbaugh’s TV show, I can think of great symbols to use in rallies against NHC – bathroom tissue rolls attached to signs saying something like: “Here’s Pelosi’s/Reid’s 1000+ page bills”!!
